Frequently Asked Questions

Does it matter if I was exposed in multiple locations?

No. It is common to have a history of exposure to dusts and fumes in different States and Territories.

Does it matter if I smoked cigarettes?

In most cases, no. Cigarette smoking is generally not connected to the development of asbestos disease. For example, mesothelioma is a cancer which only develops after being exposed to asbestos.

Does is matter if my former employer has ceased to exist?

In Queensland, it does not matter. Workers’ compensation insurance exists in Queensland which allows an employee to claim against the former employer’s policy of insurance. Difference laws could apply in other jurisdictions so it is important to obtain specific legal advice in your particular circumstances.

What if I cannot recall every single detail about my history of exposure?

It is expected that a person cannot recall every single detail of their life history. The most important matter is for you to provide us with as much information as possible. The more information we have, the more advice we can provide.

Will I be charged for initial advice and investigation?

No. We provide a free case assessment at the outset. If we believe there is a viable claim we can proceed on a “no win, no fee” basis.

As well as charging no fee, there is absolutely no obligation to proceed after the initial consultation .

Further details about our “no win, no fee” policy can be found on the About Us page and main FAQ page.

Can I claim on behalf of a loved one?

Yes. A dependency claim can usually be brought if one of your dependent family members has passed away as a result of exposure to dust or toxic fumes.
